If you’re a European citizen planning to live, study, or work in Spain for more than 90 days, you’ll need to apply for a NIE Card. This document confirms your legal residence in the country.

But how do you know if you qualify? And what documents are needed?

Here’s a quick overview of the main situations that allow you to apply for a NIE Card, along with what you’ll need to show:

1. You Have a Job Offer

If you’ve been offered a job in Spain but haven’t started working yet, you can apply for your NIE Card before your contract begins. However, there are some strict timing rules. Let´s say that the job has to be starting soon and the offer has to be recent enough. Also, you have to take into account that the position has to be for more than 3 months (counting from the appointment day).

This option is useful if you’re moving to Spain for a new role and want to get your paperwork in order in advance.

2. You Are Already Working in Spain

If you’ve already started working with a Spanish employer, you’ll need to present a valid employment contract in Spanish that lasts more than 3 months. Additionally, you must show that you’ve been registered with Spanish Social Security.

This route is suitable for those who are already employed and need to formalize their residency.

3. You Are a Student

If you’re enrolled in an officially recognized Spanish educational institution you´ll need to provide your enrollment certificate and show your EHIC (European Health Insurance Card) or a private Spanish health insurance with no co-payments.

4. You Have Sufficient Funds

If you just want to live in Spain without working or studying, you can still apply for the NIE Card, but you need to show that you can support yourself and that you are insured. In this case you have to provide a bank certificated with the proper amount and a health coverage certificate or S1 form (document that show that you have been paying Social Security in another European country).

5. You’re a Family Member of an EU Citizen

You can apply for a NIE Card as:

  • Spouse or registered partner (with an official certificate that demonstrates your relationship issued less than 3 months ago, apostilled if issued outside the EU, and officially translated if not in Spanish).
  • Minor child (with a recent birth certificate, apostilled and translated when required).

6. You’re a Posted Worker (A1 Form)

If you are working remotely or temporarily in Spain and your contract is with a company based in another EU country, you’ll need to present the A1 certificate that you have to request at the Social Security of your home country. That document shows you’re still paying social security in your country of origin, and that you’re only in Spain temporarily.

Just make sure the A1 includes a Spanish address. For example, if you’re applying in Barcelona, the A1 must mention a Barcelona address.

This is a great option if you’re a freelancer or being sent by your company to Spain for a project.
